By accessing and using the rfinub website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

These Terms constitute a legally binding agreement between you and rfinub Ltd. Your continued use of our services following any changes to these Terms will constitute your acceptance of such changes.

Description of Services

rfinub provides salon service profitability analytics systems designed specifically for beauty and spa businesses. Our services include real-time profitability tracking, staff performance analytics, client behaviour insights, and revenue optimisation tools.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We may also impose limits on certain features or restrict access to parts of our services without notice or liability.

User Obligations

You agree to use our services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of our services complies with all applicable laws and regulations in your jurisdiction.

You must provide accurate and complete information when using our services and keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to use our services to transmit, distribute, or store material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You also agree not to interfere with or disrupt our services or servers.

Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, and analytics algorithms, are the exclusive property of rfinub Ltd and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services for your business purposes. This licence does not include the right to reproduce, distribute, modify, or create derivative works from our content without our express written permission.

Any feedback, suggestions, or ideas you provide to us regarding our services may be used by rfinub without any obligation to compensate you or seek your permission.

Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

You retain ownership of any business data you provide to our analytics systems. We will use your data solely to provide our services and will not share your confidential business information with third parties except as necessary to deliver our services or as required by law.

Payment Terms

Our services are provided on a subscription basis with fees as specified in your service agreement. Payment is due in advance for each subscription period. We reserve the right to change our pricing with thirty days' notice.

If payment is not received by the due date, we may suspend or terminate your access to our services. You are responsible for all charges incurred under your account, including applicable taxes.

Limitation of Liability

To the maximum extent permitted by law, rfinub Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.

Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to us for our services in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. You acknowledge that no analytics system is perfect and that business decisions should consider multiple factors beyond our analytics insights.

Indemnification

You agree to indemnify, defend, and hold harmless rfinub Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Malta.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Termination

Either party may terminate the service agreement at any time with thirty days' written notice. We may immediately terminate or suspend your access to our services if you breach these Terms or engage in conduct that we determine to be harmful to our business or other users.

Upon termination, your right to access and use our services will cease immediately. We will provide you with access to export your data for a reasonable period following termination, after which your data may be deleted from our systems.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, limitation of liability, and governing law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services following such changes constitutes your acceptance of the new Terms.
